Penalties

There are some different factors that come into place to determine whether you are facing second degrees or third degree penalties on this kind of crime. In most case, the age of the victim when the assault occurred as well as yours will determine penalties. Here are the regulations as followed.

First degree—when this happens, the victim is 12 to 16 years old and you as the perpetrator is 25 or older when the crime occurred. This is going to result in a Class 1B felony which might result in jail for 15 years, being registered a sexual offender, and the penalties become worse if you are past the first offense.

Second degree—this is going to happen if the victim is under the age of 15 and you are 19 or older. The second degree also includes causing physical harm to the victim during the sexual act, got them pregnant, or gave them an STD. This is going to be called a Class II felony during the first penalty and requires you to spend at least a year in prison.

Third degree—This one is similar to 2nd degree, but you didn’t cause any harm to the victim during that time. This will be considered a Class IIIA felony and can mean you spend five years in jail as well as a fine of $10,000.

Sex Offender

Once you have been convicted of sexual crimes against minors, you are going to register after you get out of prison as a sex offender. You will be on this registration for a minimum of 10 years. You must report where you go to school, work, and plan to live. These places must be away from day cares, schools, and other areas where young people are common. You must also provide any names you have legally held so you can be watched. There will be counseling classes and treatments required at the end of a prison term.

Getting the defense

Dealing with the conviction of sex offender has long lasting impacts and can follow you around for over ten years, dictating where you get to live and work as well as other aspects of your life. Getting the right defense could limit your time in jail, the fines you incur, and could even help to drop the charges depending on the case at hand.
